General Court of the European Union decided that software giant and its Skype phone service was infringing the naming rights of Robert Murdoch’s Sky television. The EU court found out that two names are too similar and open to confusion.
With this decision Microsoft had lost the second round of the clash. In 2012 and 2013 the Office for Harmonisation in the International Market (OHIM) supported Sky’s complaint, but Skype then appealed to EU court.
EU court said that Skype is “visually, phonetically and conceptually” similar to Sky TV. Skype’s cloud-shaped logo is also used as one of the contributing factors to their decision by the court.
Skype can only appeal to the European Court of Justice but only on points of law within the following two months.
